suffered a traumatic brain injury 3+years ago. receive SSDI in the amount of 1619 a month. I have consulted with a bankruptcy attorney and actually gave him a retainer but have yet to file. If I were to file bankruptcy (excluding my mortgage) what consequences would there be if any. I need to keep my home as it house the photography studio and business I have been working on to create with disability vocational experts. I no longer have the energy to go down all the dead end roads I've been on. Are there any programs aimed to help people with disabilities, avoid foreclosure as this group of people has the creates obstacles to overcome. My mother passed away in Sept. 2007. My father had no insurance on her and they lived on a fixed income. Her funeral expenses were over $10,000 and he had NO money to pay for it. I had to assist with this and then help with his expenses until he was able to trim his household budget to be able to get by. I began to fall behind about Feb. of 2008. After I was behind 3 payments GMAC would not accept any payments to try to catch the loan up. I then fell about 20 feet from a ladder at my home in July 2008. I broke a leg and suffered a concussion, and was unable to work. I was able to collect sick leave at my primary job, but had no such benefit at my second job (which provides 50% of my income). While I was off with the injuries, i was served with forclosure filing papers. they did not contain a court date and the process server told me that I still had time to work with them as no court date was set. I contacted GMAC when I got back to work and they would not work anything out with me until I filled out some paperwork for them. I got a packet, filled out the papers as required and faxed it to them. I heard nothing back, so called them a couple of weeks later. They then sent a far more detailed information request. All this time I was trying to get them to take some money from me, and let me catch up the loan at an accelerated payment rate but they would not. I faxed the original paperwork to them again and called a few days later. They finally acknowledged that they had received it. By this time it was Nov. 24, 2008. the person I spoke to that day was Steve in the default division. He agreed to a workout. If I could pay $1700 up front, they would put me on a fixed rate of 8.75% (better than my ARM rate which had adjusted to 9.99%). I told him that I was finally relieved to get things going and not lose my home. He said I should receive the workout packet by Dec. 12th. Instead on Dec.2nd I received notice that the house was forclosed on Nov. 21st. I was not notified that a court date had ever been set nor was I subpeoned though the court document said I was. I called GMAC back that day in a panic and they told me not to worry that Steve was still working on my plan and I would get the paperwork soon. Today I received notice that the house has been set for Sheriff's sale on Jan. 6! I tried to call GMAC but they are not open on Sat. CAN I SAVE MY HOUSE? PLEASE HELP! I can pay for my house! My take home after tax income is now $3070 per month at my current rate of pay. My ARM payment was $879 per mo. and my other expenses do not exceed $1800 per mo. I am no longer having to pay for my mother\'s funeral (paid off) or help my father (he\'s working at age 77, and my brothers have stepped up to help so I don\'t lose my house). GMAC is my mortgage holder (it has been sold twice in two years).

I was 22 years old (naive to say the least) I found my self with two mortgages and the first was an adjustable loan with an 3 year arm and these mortgages did not include insurance or taxes. I then two years later was diagnosed with end stage renal failure and was put on dialysis awaiting a kidney transplant. I applied for Social Security to help with bills while I was not working. I was approved, however there was a five month waiting period, needless to say I became behind on my payments. I called GMAC and told them what was happening and asked if I could work something out until I started to receive my social security, they agreed and told me to send the approval documents (which I did). Two months later while I was recovering from a transplant I was served with forclosure papers. I had to file for a chapter 13 bankruptcy, because I was too sick and weak to fight them. I became well and started working some, and that is when this wonderful 3 year arm adjustable rate came sneaking up. My payments went from 707.60 with out taxes or insurance to 1147.00 with out taxes or insurance. I again was unable to keep up, I tried talking to my bankruptcy attorneys and they found a loop hole (so they thought) finding out the GMAC had not sent me a monthly statement since the birth of my loan, i really didn't know any different this was my fist mortgage loan. They instructed me to hold payment until this was resolved and they would negotiate better terms, the attorney I was assigned was fired shortly after and I was left with back mortgage payments and fees. I was able to pay some, however I am not faced with back fees and unable to keep up with the increased payments, I have horrible credit because of all this and I just need help getting back on track. Laying it all on the table: I am behind about 3 months on both mortgages and ow about $5000.00 in back property taxes because I was told it would be included in the bankruptcy which it was not. My dream at this point would be to have my past due payments put back on the end of the loans and to negotiate with GMAC a lower non-adjustable rate where my taxes and insurance would be included.
