We have fallen behind in payments due to temporary work loss, lay offs.  We are both gainfully employed at steady jobs and are ready to start making payments on time to keep the house.  America\'s Servicing Company is our 80% mortgage and Wilshire Credit Corp has our 20%.  We owe $14600 to America\'s and we are behind $2400 to Wilshire.  We have submitted paperwork to ASC for forebearance or loan modification and they have denied us either opportunity.  The house is in active foreclosure but as of Friday June 6th no sale date had been set. We feel on hard times about 2 years ago.  We fell behind on our mortgage and tried to work with Wilshire our lender.  They continue to promise a modification but continue to provide us with these ridiculous repayment plans that we could not afford while they continued to adjust the interest rate.  We are now considerably behind, they have refused to accept payments from us until the entire past due balance is paid, and we are now forced to consider CH 13. Our situation has changed.  I have been employed for 16 months now in a stable position that allows us to afford the home if we could obtain a reasonable plan.

I have been behind on my mortgage payments for about 11 months now back in April I got a hold of Wilshire the company that was in charge of receiving my payments the original mortgage was from first Franklin.  In April I contacted Wilshire and was told to check some information to them so that they could rework the mortgage I did so.  I was told to wait until I heard from them before I did anything.  At that time according to the foreclosure notice the auction was to take place in April I was told that they will lead push back the auction date.  Until we could come to some type of agreement and this paperwork that I received from the court the auction took place March 28, 2008 so it seems what I was doing to try and correct this would have done me no good.  I have tried calling first Franklin Wilshire and Wells Fargo and cannot find any information about what is going on please  Monday I received a summons to appear in court on Tuesday he October 28.  According to this paperwork my previous mortgage company First Franklyn auctioned the house off on March 28.  I'm not sure what is happening I was making my payments to Wilshire trying to work with them now I see that first Franklyn sold the property at auction to Wells Fargo Bank I have no account number or any information we are this mortgage is being held.  I\'m just trying to save my home Please help me.  I don\'t know what to do I know I screwed up and if it\'s too late its too late but I have to try.

I'm writing if you could please help us get back on track and save our home i know we can do it but we really need help on what to do first we been though so much that we couldn't get back on track. When we first brought our home Me & my husband were working and we had only our 1 son we were doing good every thing was wonderful then my husband parents need help with taking them to their doctors appointments and things they need to do. so they move in with us then i found out later that year that i was pregnant with my 2nd child. When my 2nd child was born he had so much different health problems so i had to stay home for a year to take care of him take my son and parents in-law to their doctors appointments. This past year on Sept. i had to go back to work because we were behind on our bills so i had my parents come down from Alaska to watch my child so i could go back to work because for two years my husband was the only income we had to support our family. On Oct. 25 my husband 's father when back home to Samoa to his bothers funeral where he past away 2 days when he got there. So my husband had to pay for him to come back here to Hawaii and plan his funeral arrangements because my father in-law had no life insurance our funeral plan so my husband had to pay for everything that really set us far back on bills and our mortgages. When my father in-laws funeral was over 2 weeks after his funeral my mother in-law past away and we had to do everything again because even she didn't have any insurance or funeral plan. And i just stated my job in Sept. then all if this happen. We now we can start geting back on track but we need some help to get us started again.
